Terms of Service

1. Operator

CreditFeed.ai ("CreditFeed," "we," "us," or "our") is a trade name of SCV Labs, LLC, a limited liability company organized under the laws of the United States. All references to CreditFeed in these Terms refer to SCV Labs, LLC as the operating entity.

2. Acceptance of Terms

By creating an account, purchasing credits, or otherwise accessing or using CreditFeed.ai (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not access or use the Service.

3. Description of Service

CreditFeed is a business intelligence platform that aggregates, classifies, and enriches publicly available commercial filing data. The Service provides users with enriched organization profiles that may include AI-classified financing type, verified contact information, compliance indicators (such as DNC and TCPA status), and other derived data attributes.

CreditFeed does not originate, broker, or fund loans or merchant cash advances. We are a data intelligence provider. The Service is not a substitute for independent due diligence, legal advice, or compliance review.

4. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you are using the Service for lawful business purposes and not for any personal, family, or household use.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hello@creditfeed.ai of any unauthorized use of your account or any other security breach.

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or are otherwise engaging in activity that could harm CreditFeed, its users, or third parties.

6. Credits, Purchases, and Refunds

6.1 Credit-Based Model. The Service operates on a credit-based model. Credits are purchased in advance and consumed when you unlock (reveal) an organization's enriched profile. Specific credit costs per action are displayed in the product interface at the time of purchase and may vary based on the data attributes requested.

6.2 Pricing. Credit packages are offered at prices published on the Service. We reserve the right to change pricing at any time, but price changes will not affect credits you have already purchased.

6.3 No Cash Value. Credits have no cash value, are non-transferable, and cannot be exchanged for cash. Unused credits do not expire but are forfeited upon account termination for cause.

6.4 Refunds. CreditFeed may issue credit refunds (returned to your credit balance, not as cash) in the limited circumstances described below. Refund requests must be submitted within fourteen (14) days of the credit being consumed. All refunds are issued as credits, not cash, and are granted at CreditFeed's sole discretion.

6.5 Email Refund Eligibility. If CreditFeed indicated that an email address was deliverable and the email hard-bounced, you may request a credit refund by providing evidence that, at the time the email was sent: (a) your sending domain was active and properly configured with valid SPF, DKIM, and DMARC records; (b) your sending domain was not listed on any major email blacklist; (c) the bounce was a permanent hard bounce (not a soft bounce, temporary deferral, or spam-folder placement); and (d) the email was sent within a reasonable timeframe after the credit was consumed. CreditFeed reserves the right to independently verify bounce claims and to deny refund requests where the bounce resulted from the sender's domain reputation, content filtering, or sending infrastructure issues rather than an invalid email address.

6.6 Mobile Phone Refund Eligibility. If CreditFeed indicated that a phone number was a deliverable mobile number and the number was not reachable, you may request a credit refund by providing evidence that, at the time the outreach was attempted: (a) your own phone number or SMS sender ID was active, valid, and in good standing with your carrier or SMS provider; (b) your number was not blocked, suspended, or flagged by your carrier or SMS provider; (c) the failure was due to the recipient number being invalid, disconnected, or not a mobile line (not due to carrier filtering, DNC blocking, or the recipient having blocked your number); and (d) the outreach was attempted within a reasonable timeframe after the credit was consumed. CreditFeed reserves the right to independently verify delivery failure claims and to deny refund requests where the failure resulted from the sender's infrastructure, carrier restrictions, or recipient-side blocking rather than an incorrect phone number.

6.7 Refund Disclaimer. CreditFeed strives to provide the most accurate data available at the time of service. All contact data, enrichment attributes, and classification signals are derived from third-party data vendors, public records, and proprietary research methods and represent our best assessment at the time the data was generated. However, contact information can change at any time — phone numbers are reassigned, email addresses are deactivated, businesses close, and ownership changes occur. CreditFeed makes no guarantee that any individual data point will remain accurate beyond the moment it was generated. Refunds are limited to cases where the data was demonstrably inaccurate at the time it was provided, not cases where the data became stale after delivery. The burden of proof for all refund claims rests with the requesting party.

6.8 Payment Processing. Payments are processed by our third-party payment processor (currently Stripe). By making a purchase, you agree to the payment processor's terms of service. We do not store your full payment credentials.

6.9 Free Credits. We may, at our discretion, offer free credits to new users. Free credits are subject to the same usage terms as purchased credits and may be limited in quantity, functionality, or duration at our discretion.

7. Acceptable Use

You agree to use the Service only for lawful business purposes. Without limiting the foregoing, you agree not to:

  • Resell, sublicense, redistribute, syndicate, or otherwise make available to any third party any data obtained through the Service, whether in raw, modified, or aggregated form, without our prior written consent;
  • Use the Service or any data obtained through it to harass, stalk, threaten, intimidate, or discriminate against any individual or entity;
  • Use data obtained through the Service to make credit, employment, insurance, housing, or other decisions that would be subject to the Fair Credit Reporting Act (FCRA) or similar regulations. The Service is not a consumer reporting agency and does not provide consumer reports;
  • Use automated means (bots, scrapers, crawlers, or similar tools) to access the Service in a manner that exceeds reasonable use or circumvents rate limits, access controls, or other technical restrictions;
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code, algorithms, classification models, or data taxonomy of any part of the Service;
  • Use the Service in any way that violates applicable federal, state, or local law, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state commercial solicitation laws, or state-specific merchant cash advance or commercial financing disclosure laws;
  • Share account credentials with unauthorized users or allow multiple individuals to access the Service under a single account without authorization;
  • Use the Service to build or contribute to a competing product, dataset, or service.

8. Your Compliance Responsibilities

You acknowledge and agree that you are solely responsible for your compliance with all applicable laws and regulations governing your use of data obtained through the Service, including but not limited to:

8.1 Telephone Outreach. If you use contact data from the Service for telephone outreach, you are solely responsible for compliance with the TCPA, the Telemarketing Sales Rule (TSR), the National Do Not Call Registry, state-specific Do Not Call laws, and any other applicable regulations. While CreditFeed may provide DNC status indicators and TCPA litigator flags as informational data attributes, these indicators are provided on an "as-is" basis and do not constitute legal advice or a compliance program. You are responsible for independently verifying compliance before initiating any outreach.

8.2 Email and SMS Outreach. If you use contact data from the Service for email or SMS outreach, you are solely responsible for compliance with the CAN-SPAM Act, the TCPA, state-specific anti-spam and commercial messaging laws, and any other applicable regulations.

8.3 State Regulatory Compliance. Certain states regulate commercial financing solicitation, merchant cash advance brokering, and related activities. You are solely responsible for obtaining and maintaining any required licenses, registrations, or certifications in the jurisdictions in which you operate.

8.4 FCRA Disclaimer. The Service is not a consumer reporting agency as defined by the Fair Credit Reporting Act (15 U.S.C. §1681 et seq.). Data provided through the Service does not constitute a "consumer report" and may not be used as a factor in determining any individual's eligibility for credit, insurance, employment, housing, or any other purpose covered by the FCRA.

9. Data Accuracy and Limitations

9.1 Public Record Data. CreditFeed aggregates data from publicly available sources, including state and federal commercial filing databases. We do not verify the accuracy of the underlying public records and are not responsible for errors, omissions, or outdated information in those records.

9.2 AI Classification. Financing type classifications, predictive signals, and other AI-derived attributes are generated by machine learning models and are probabilistic in nature. Classification confidence scores indicate the model's estimated probability and are not guarantees of accuracy. You should not rely solely on AI classifications for business decisions without independent verification.

9.3 Data Provided in Good Faith; No Guarantee of Accuracy or Results. CreditFeed delivers data that reflects our best understanding of each organization at the time of service, drawing from public records, third-party data vendors, and proprietary research. We invest significantly in data quality and verification. However, the business information landscape is inherently dynamic — businesses close, ownership changes, phone numbers are reassigned, and records are amended — and no aggregation of third-party sources can guarantee absolute accuracy at any given moment. CreditFeed does not warrant the accuracy, completeness, or timeliness of any individual data point, and you acknowledge that some degree of variance is inherent in any data product of this nature. CreditFeed further does not guarantee that use of the Service will result in any particular business outcome, including but not limited to funded deals, closed sales, successful outreach campaigns, or return on investment. Any case studies, examples, or projections presented in our marketing materials are illustrative only and do not constitute a guarantee of similar results.

10. Intellectual Property

10.1 Our IP. The Service, including but not limited to its software, user interface, design, classification algorithms, data taxonomy, scoring models, enrichment pipeline, and all associated documentation and marketing materials, is the proprietary property of CreditFeed and its licensors and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

10.2 Data License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use data obtained through the Service solely for your own internal business purposes. This license does not include the right to resell, redistribute, or sublicense any data.

10.3 Feedback. If you provide feedback, suggestions, or ideas regarding the Service, you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use such feedback for any purpose without compensation or attribution to you.

11. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to the collection, use, and processing of information as described therein.

You acknowledge that data available through the Service is derived from publicly available records and third-party sources and may include business contact information for individuals associated with the organizations profiled. You agree to handle all such data in accordance with applicable privacy and data protection laws.

12. Indemnification

You agree to indemnify, defend, and hold harmless CreditFeed, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service or any data obtained through the Service; (b) your outreach, communications, or business dealings with any individuals or entities whose information you obtained through the Service; (c) your violation of these Terms; (d) your violation of any applicable law or regulation, including but not limited to the TCPA, CAN-SPAM Act, FCRA, or any state commercial financing laws; or (e) any third-party claim arising from your use of data obtained through the Service.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TITLE, AND NON-INFRINGEMENT. CREDITFEED DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, CREDITFEED MAKES NO WARRANTY OR REPRESENTATION REGARDING: (A) THE ACCURACY, COMPLETENESS, OR CURRENCY OF ANY DATA, CLASSIFICATIONS, SCORES, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE; (B) THE ACCURACY OF AI-GENERATED CLASSIFICATIONS OR PREDICTIVE SIGNALS; (C) THE DELIVERABILITY, REACHABILITY, OR VALIDITY OF ANY CONTACT INFORMATION; OR (D) THE SUITABILITY OF ANY DATA FOR YOUR PARTICULAR USE CASE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREDITFEED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF CREDITFEED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREDITFEED'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO CREDITFEED IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

15. Dispute Resolution and Governing Law

15.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

15.2 Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall take place in New York, New York, and the arbitrator's award shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.

15.3 Class Action Waiver. You agree that any arbitration or legal proceeding shall be conducted on an individual basis only and not as a class action, collective action, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against CreditFeed.

15.4 Small Claims Exception. Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Upon termination for cause (including but not limited to violation of these Terms), any unused credits in your account will be forfeited. Upon termination without cause by CreditFeed, we will refund the value of any unused purchased credits on a pro-rata basis.

You may terminate your account at any time by contacting us at hello@creditfeed.ai. Termination of your account does not entitle you to a refund of unused credits unless otherwise required by applicable law.

Sections 7, 8, 9, 10, 12, 13, 14, and 15 shall survive any termination of these Terms.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where practicable, by notifying you via email or through the Service. Your continued use of the Service after the effective date of any modifications constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, your sole remedy is to stop using the Service.

18. Miscellaneous

18.1 Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and CreditFeed regarding the Service and supersede all prior agreements and understandings.

18.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

18.3 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice.

18.5 Force Majeure. CreditFeed shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, government actions, interruptions in third-party data sources, or internet or infrastructure outages.
